Another day, another fast-f00d fracas, but who knew that McDonald’s offered VIP parking? At least one franchise apparently does. On Friday, a Colorado jury convicted a 52-year-old contractor of third-degree assault after a confrontation over a parking space that the victim, age 85, had evidently been using for every day for about 16 years.
The men had clashed before over the preferred parking space. On July 29, 2008, the victim found that the contractor was again blocking “his” space, and went over to the contractor’s truck and tapped or knocked on the door. Prosecutors say the contractor “knew exactly what he was doing” when he swung open his truck door and knocked the senior citizen to the pavement.
A witness testified that [the contractor] jumped out of his truck after knocking [the victim] to the ground, grabbed the elderly man, cocked his fist and said, “you want to fight, you son of a b____?”
The incident took place in the town of Loveland (“Love-Land”), and it took the jury less than three hours to find the contractor guilty. The contractor’s defense attorney argued that the older man triggered the incident by approaching the truck in the first place. “It’s so incredible because we’re talking about a parking space. At a doggone McDonald’s. It’s tragic.”
A judge will hand down a sentence after the Colorado equivalent of the probation department completes its background report. The man could get a stiffer sentence because of the victim’s age. [Coloradoan.com]
Separately, the U.S. Court of Appeals for the 4th Circuit in Richmond has reinstated a personal injury lawsuit against McDonald’s over a defective chicken sandwich. “In the lawsuit, [the man] claims his fried chicken sandwich exploded with scalding grease when he bit into it, burning his lips and face.” The court returned the case for trial in Alexandria, Virginia, federal court, but a new trial date has yet to be scheduled.
